Energy Boss Rising Stars Website Terms of Service

1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of energybossrisingstars.com and any related pages, forms, assessments, communities, and online programs (together, the "Site" and "Services"). The Site and Services are owned and operated by TruYou Wellness LLC, a Missouri limited liability company operating under the brand names Energy Boss and Energy Boss Rising Stars ("EBRS," "we," "us," or "our").

By accessing the Site, submitting a form, completing an assessment, booking a call, or purchasing a program, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or Services.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Services. If you use the Services on behalf of an employer or other organization, you confirm that you have authority to bind that organization to these Terms, and "you" includes that organization.

3. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms. Material changes to an active paid program will not apply retroactively without your consent.

4. Our Services

EBRS provides leadership development, well-being, and energy management programs for professionals and organizations. Services may include the Rising Star Readiness Assessment, qualification and enrollment calls, the Rise Now Program (including Essentials and Full Journey tracks), self-paced course content, live sessions, and access to our online community.

We may add, change, or discontinue any part of the Services at any time. Program descriptions, schedules, and facilitators may change, and we will make reasonable efforts to notify enrolled participants of material changes.

5. Assessments and Calls

Assessments and introductory calls are tools to help both of us decide whether a program is a good fit. Completing an assessment or call does not guarantee enrollment. We reserve the right to decline or end enrollment at our discretion.

Assessment results reflect your own responses at a point in time. They are for development purposes only and are not a clinical, psychological, or employment evaluation.

6. Accounts and Community Platforms

Some Services are delivered through third-party platforms, such as our community and course platform. You are responsible for keeping your login credentials secure and for all activity under your account. Your use of those platforms is also subject to their own terms and policies.

7. Purchases, Payments, and Refunds

Prices, payment plans, and program terms are presented at the time of enrollment. By purchasing, you authorize us or our payment processor to charge the payment method you provide, including any scheduled installments.

If you choose a payment plan, you are responsible for the full program price, even if you stop participating. Missed payments may result in paused or ended access.

Refunds, cancellations, and transfers are governed by the enrollment agreement or program terms you accept at checkout. Where those terms are silent, all sales are final once program access has been granted. Organizational (B2B) engagements are governed by the separate agreement signed with your organization.

8. Participation Requirements

Some programs require ongoing participation, such as completing homework, engaging in the community, or attending scheduled live sessions. Results depend on your effort and consistency. Failure to meet stated participation requirements may affect your access or completion status, and does not entitle you to a refund.

9. Intellectual Property

All content on the Site and in our programs, including text, videos, recordings, workbooks, assessments, frameworks, graphics, logos, and trademarks, is owned by TruYou Wellness LLC or its licensors and is protected by copyright and trademark law.

We grant you a limited, personal, non-transferable license to access and use program materials for your own development while your access is active. You may not copy, record, resell, redistribute, publicly share, or create derivative works from our materials, or use them to coach or train others, without our written permission.

10. Your Content

You keep ownership of anything you post, submit, or share with us, such as community posts, homework, comments, or testimonials ("Your Content"). By submitting Your Content, you give us a non-exclusive, royalty-free license to host, display, and use it to operate and improve the Services.

We will not publish your name, likeness, testimonial, or story in our marketing without your separate permission.

11. Community Standards and Confidentiality

Our community works because people feel safe being honest. When participating, you agree to:

  • Treat facilitators and fellow participants with respect
  • Keep what other participants share in sessions and the community confidential
  • Not post content that is harassing, hateful, threatening, obscene, or unlawful
  • Not promote unrelated products, services, or solicitations to other members
  • Not record live sessions or share access with anyone else

We may remove content or suspend or end access, without refund, for violations of these standards.

12. Prohibited Uses

You may not use the Site to break the law, infringe anyone's rights, interfere with the Site's security or operation, upload malicious code, scrape or harvest data, or impersonate any person or organization.

Our programs focus on leadership development, well-being, and performance. They are educational and developmental in nature. They are not therapy, counseling, medical care, or a substitute for advice from a licensed physician, mental health professional, attorney, or financial advisor. If you are experiencing a health or mental health concern, please contact a qualified professional. In an emergency, call 911.

14. No Guarantee of Results

Any examples, testimonials, or outcomes shared on the Site reflect individual experiences and are not typical or guaranteed. Your results depend on many factors, including your own effort, circumstances, and follow-through.

15. Disclaimer of Warranties

The Site and Services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

16. Limitation of Liability

To the fullest extent allowed by law, TruYou Wellness LLC and its owners, partners, facilitators, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from your use of the Site or Services. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose.

17. Indemnification

You agree to defend, indemnify, and hold harmless TruYou Wellness LLC and its owners, partners, facilitators, and contractors from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your use of the Services, Your Content, or your violation of these Terms.

The Site may link to or rely on third-party tools, such as scheduling, payment, and community platforms. We are not responsible for their content, policies, or performance.

19. Termination

We may suspend or end your access to the Site or Services at any time for violation of these Terms or conduct we reasonably believe is harmful to other participants or to EBRS. Sections that by their nature should survive termination, including intellectual property, payment obligations, disclaimers, limitation of liability, and indemnification, will survive.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to that jurisdiction. Before filing any claim, both parties agree to first try to resolve the dispute informally by contacting the other in writing and allowing 30 days for a good-faith response.

21. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and any enrollment or organizational agreement you sign, are the entire agreement between you and us regarding the Site and Services. If these Terms conflict with a signed enrollment or organizational agreement, the signed agreement controls.
